These terms and conditions (the “Terms and Conditions”) govern the use of www.kentinvictachamber.co.uk (the “Site”). This Site is owned and operated by Kent Invicta Chamber of Commerce (the “Company”).
By using this Site, you indicate that you have read and understand these Terms and Conditions and agree to abide by them at all times.
Definitions
In this agreement the following words shall have the following meanings:
- “Us” refers to Kent Invicta Chamber of Commerce, a Company Limited by Guarantee, registered in England No. 2794615 and “we” and “our” will be construed accordingly.
- Kent Invicta Chamber of Commerce Registered Office, Ashford Business Point, Waterbrook Avenue, Sevington, Ashford, Kent TN24 0LH.
- “You” refers to the customer or user who uses the Site subject to these terms and conditions and “your” will be construed accordingly.
- “Site” means the site on the World Wide Web located at kentinvictachamber.co.uk, and “Content” means the information and other material available within the Site.
1. Intellectual Property
1.1 All content published and made available on our Site is the property of Kent Invicta Chamber of Commerce, the Site’s creators and its licensors. This includes, but is not limited to images, text, logos, documents, downloadable files and anything that contributes to the composition of our Site.
1.2 You are permitted to print and download extracts from the Website for your own use on the following basis:
- (a) no documents or related graphics on the Website are modified in any way;
- (b) no graphics on the Website are used separately from the corresponding text; and
- (c) the Company’s copyright and trade mark notices and this permission notice appear in all copies.
1.3 If you breach any of the terms in this legal notice, your permission to use the Website automatically terminates and you must immediately destroy any downloaded or printed extracts from the Website.
1.4 Subject to clause 1.2, no part of the Website may be reproduced or stored in any other website or included in any public or private electronic retrieval system or service without the Company’s prior written permission.
1.5 Any rights not expressly granted in these terms are reserved.
2. Acceptable Use
2.1 As a user of our Site, you agree to use our Site legally, not to use our Site for illegal purposes, and not to:
- Violate the intellectual property rights of the Site owners or any third party to the Site.

We are not responsible for the content, policies, or practices of any third party website or service linked to on our Site. The Company does not endorse or make any representations about them, or any material found there, or any results that may be obtained from using them. It is your responsibility to read the terms and conditions and privacy policies of these third party websites before using these sites.
4.2 You may create links to the Website provided you have first obtained written permission from the Company, do not replicate the home page of the Website, and subject to the following conditions:
- (a) you do not remove, distort or otherwise alter the size or appearance of the Kent Invicta Chamber of Commerce logo;
- (b) you do not create a frame or any other browser or border environment around the Website;
- (c) you do not in any way imply that the Company is endorsing any products or services other than its own;
- (d) you do not misrepresent your relationship with the Company nor present any other false information about the Company;
- (e) you do not otherwise use any Kent Invicta Chamber of Commerce trademarks displayed on the Website without express written permission from the Company;
- (f) you do not link from a website that is not owned by you; and
- (g) your website does not contain content that is distasteful, offensive or controversial, infringes any intellectual property rights or other rights of any other person or otherwise does not comply with all applicable laws and regulations.
4.3 The Company expressly reserves the right to revoke the right granted in clause 4.2 for breach of these terms and to take any action it deems appropriate.
4.4 You shall fully indemnify the Company for any loss or damage suffered by the Company or any of its group companies for breach of clause 4.2.
5. Registration to the Members Area
5.1 Each registration is for a single user only. The Company does not permit you to share your user name and password with any other person nor with multiple users on a network.
5.2 You are responsible for the security and proper use of your user name and passwords used from time to time in connection with the Site and must take all necessary steps to ensure that they are kept confidential, secure, used properly and not disclosed to unauthorised people.
5.3 You must immediately inform us if there is any reason to believe that your user name or password has or is likely to become known to someone not authorised to use it or is being or is likely to be used in an unauthorised way. If you forget or lose a password or user name you must contact us and satisfy such security checks as we may operate.
5.4 We reserve the right to suspend user name and password access to the Site and the Services if at any time we consider that there is or is likely to be a breach of security. We reserve the right (in our sole discretion) to require you to change any or all of the passwords used by you in connection with the Site. You must immediately inform us of any changes to the information you supplied when registering for the Site.
6. Service access
6.1 While the Company endeavours to ensure that the Website is normally available 24 hours a day, the Company shall not be liable if for any reason the Website is unavailable at any time or for any period.
6.2 Access to the Website may be suspended temporarily and without notice in the case of system failure, maintenance or repair or for reasons beyond the Company’s control.

8. Limitation of Liability
8.1 Kent Invicta Chamber of Commerce and our directors, officers, agents, employees, subsidiaries, and affiliates will not be liable for any actions, claims, losses, damages, liabilities and expenses including legal fees from your use of the Site.
9. Indemnify
9.1 Except where prohibited by law, by using this Site you indemnify and hold harmless Kent Invicta Chamber of Commerce and our directors, officers, agents, employees, subsidiaries, and affiliates from any actions, claims, losses, damages, liabilities and expenses including legal fees arising out of your use of our Site or your violation of these Terms and Conditions.
10. Applicable Law
10.1 These Terms and Conditions are governed by the laws of the Country of England.
11. Severability
11.1 If at any time any of the provisions set forth in these Terms and Conditions are found to be inconsistent or invalid under applicable laws, those provisions will be deemed void and will be removed from these Terms and Conditions. All other provisions will not be affected by the removal and the rest of these Terms and Conditions will still be considered valid.
12. Changes
12.1 These Terms and Conditions may be amended from time to time in order to maintain compliance with the law and to reflect any changes to the way we operate our Site and the way we expect users to behave on our Site. We will notify users by email of changes to these Terms and Conditions or post a notice on our Site.
13. Data Protection
13.1 Unless we have your express consent, we will only disclose personal data to third parties if this is required for the purpose of completing your request to us and for reporting website use to our partners. This is subject to the proviso that we may disclose your data to such as members of our own group, our own professional advisers who are bound by confidentiality codes, and when we are legally obliged to disclose your data.

14.1 We explicitly ask when we need information that personally identifies you (“Personal Information”). For example, if you wish to register as a provider of information for the Site, we ask you for your name and email address. The way that we deal with your Personal Information is described in our Privacy Statement. If you purchase products or services through the Site or participate in any competitions on the Site, we will provide your personal information to the necessary third parties. We also use your personal information to operate the Site and to keep you up to date with relevant news and initiatives via our email newsletter.
14.2 If you require us to delete the Personal Information we hold about you and if you wish us to do so, please notify us by email. If at any time you believe that we have not adhered to these principles, please notify us by email and we will use all commercially reasonable efforts to determine and correct the problem.
15. Miscellaneous
15.1 Notices shall be given to the relevant party at the addresses given by you, or at such address as is notified to the other to this purpose.
15.2 This agreement constitutes the whole agreement between the parties and can only be varied in writing.
15.3 We may assign the benefit (subject to the burden) of this agreement to any purchaser of our business.
15.4 The Site is used at your own risk. We accept no liability for any loss or damage to your hardware and/or software and/or data resulting from your access and/or use of the Site.
15.5 Your statutory rights are not affected at all by these terms and conditions.
15.6 This agreement shall be governed by and construed in accordance with the laws of England. Any dispute will be dealt with by the English courts.
15.7 Each party confirms that, save as expressly set out in this agreement, no term of this agreement is enforceable under the Contracts (Rights of Third Parties) Act 1999 by any third party who but for that Act would not have been entitled to enforce such terms.
